Pregnant woman stabbed ex-partner in self-defence

A HEAVILY pregnant woman who stabbed her ex-partner in the leg after he attacked her, has been fined but not further punished.

Hervey Bay Magistrates Court was told Sammy Jay Clay was 31 weeks pregnant when she went to her ex-partner Joe Henry's Point Vernon address to return some of his property.

Police prosecutor Sergeant Jeanette Grigoris said paramedics had arrived to find Henry "sweating profusely" and Ms Clay holding a tea towel to his bleeding leg.

She said that while Henry did not make a complaint, the fact remained that Ms Clay had stabbed him while she was subject to an order which prevented the pair from having contact.

Aboriginal and Torres Strait Islander Legal Service representative Michael Riddell said Ms Clay had inflicted the stab wound in self defence after she was slapped and hit by an intoxicated Henry.

He pointed out that both had been charged with breaching the order.

Mr Riddell also told the court his client did not want a relationship with the father of her unborn baby, due in two weeks, but wanted to have the orders changed so he could still be involved in his child's life.

Hervey Bay Magistrate Graeme Tatnell accepted that while Ms Clay may have had a defence for the stabbing, any further breaches of domestic violence orders would land her behind bars and her children in the care of the State.

The Chronicle understands another of Ms Clay's former partners is serving a life sentence for the murder of her brother Cleveland Clay.

Simeon Blair was found guilty of bashing Mr Clay to death with a piece of wood outside a Maryborough pub in 2012.
