Suspended sentence for breast-sucking man

A 17-YEAR-OLD female panicked after waking to find her boyfriend's father sexually assaulting her.

The Mackay man, who cannot be named for legal reasons, pleaded guilty in the District Court in Mackay this week to one charge of sexual assault against his son's girlfriend, who was pregnant with his grandchild at the time of the offence.

Prosecution barrister Chris Winlaw told the court that on March 6, 2011, the 51-year-old man was drinking at home while his son and son's girlfriend were out socialising separately with friends.

Mr Winlaw said the victim, who was staying with her boyfriend's family at the time, returned home alone and went to her room to watch television.

He said the woman had noticed her boyfriend's father and brother drinking in the kitchen and mother sleeping on the couch when she entered the house.

He said later that evening she woke to find her boyfriend's father naked, on his hands and knees, leaning over and "sucking at her breast".

The man had pulled her top down while she slept, he said. The woman panicked and ran out of the house to call for help.

"She was five months pregnant ... with his grandchild," Mr Winlaw said.

"He'd been ... drinking excessively."

He said the man denied his actions to police, who helped the victim move out of the home.

Defence barrister Bronwyn Hartigan said the man had been married for 32 years and had seven kids.

She said his wife was present in court to support him.

The man was "grossly intoxicated" at the time of the offence and had consumed a few beers and shared three-quarters of a bottle of rum with his eldest son, she said.

The man had relevant criminal history of a similar nature from when he was 26, Ms Hartigan said.

Judge John Baulch described the offence as "appalling", saying the man had abused his position of responsibility by assaulting a teenager living under his roof. "It's an appalling thing that you've done," he said.

He sentenced the man to one year in prison, wholly suspended for a period of two years. The man sat in the dock during the hearing and stared at the ground, glancing up at the judge when his sentence was handed down.
